Online Agreement Disclosure

This Agreement and Disclosure provides information about Holy Rosary Credit Union, PAT (Personal Automated Teller by telephone) and Online Banking. For the purpose of this agreement, "I", "me," and "mine" shall refer to each Member who is eligible and signs up for PAT or Online Banking. "Credit Union" shall refer to Holy Rosary Credit Union where the Member has the accounts accessed through PAT and Online Banking. All references to time of day in this Agreement and Disclosure refer to Central Standard Time.

Except as set forth in this agreement, or in any later agreement concerning Credit Union’s PAT and Online Banking Systems, the membership agreement and other disclosures and agreements for accounts previously given to me (including the Regulation E Section and its liability provisions) will govern all transactions made on Credit Union’s PAT and Online Banking Service. All funds transferred from a loan account will be subject to the applicable loan agreement for accessing proceeds and secured by any security agreement for accessing your loan proceeds.

A. Eligibility for PAT and Online Banking:

I understand that in order to use the Pat System and Online Banking, I must have an account in good standing and a PAT access code number (PIN) and/or an Online Banking access code number with the Credit Union.

B. Equipment and Technical Requirements:

I understand that to use Online Banking I must have Internet Access through an Internet Provider such as Postnet or InLink and Internet Browser software such as Safari or Internet Explorer version 8.0 or 9.0, also recommended is the use of 128 bit encryption with all browsers. The current supported browsers are listed within the Online Banking help pages.

To use the PAT telephone system, you must have a touch-tone phone. I understand that the Credit Union does not make any warranties on equipment, hardware, software or Internet Provider Service, or any part of them, expressed or implied, including, without limitation, and warranties of merchantability or fitness for a particular purpose. The Credit Union is not responsible for any loss, injury or damages, whether direct, indirect, special or consequential, caused by the Internet Provider, any related software, or the Credit Union’s PAT systems or the use thereof or arising in any way out of the installation, use of maintenance of my personal computer hardware, software or other equipment.

C. General Information about PAT Systems

I may use PAT to: (1) check account balances; (2) transfer money from the savings or checking account or make a payment on a Credit Union loan with the exception of a Visa payment; (3) check the history on my accounts. With Online Banking, you may do all of those things plus download account history to hard drive or to financial software such as Quicken. PAT and Online Banking may be temporarily unavailable due to Credit Union record updating or technical difficulties. Each Service is discussed further in this Agreement and Disclosure. I authorize the Credit Union to charge my designated account(s) for any transactions accomplished through the use of these systems where applicable.

D. Transfer Between Credit Union Accounts

I may designate accounts at the Credit Union between which I may transfer funds electronically through PAT and Online Banking. I authorize the Credit Union to transfer funds electronically between my designated account(s) according to my instructions initiated through the systems. All transfer transactions are immediately deducted from my account. Each of these accounts must be in my name. I may designate accounts at the Credit Union in which to transfer funds not in my name provided all accounts owners (jointly held or otherwise) acknowledge the processing of the cross member transfers. This access may be obtained by contacting the Credit Union and providing specific written approval.

I understand that under Federal Reserve Board Regulation D, I am permitted to make no more than six (6) transfers or withdrawals from the savings or money market account per month (not counting ATM and teller transactions). PAT system transfers are counted toward the six total permitted transfers or withdrawals. If I exceed the limit, the Credit Union may restrict the savings or money market account and/or may transfer the funds to my checking account. Further explanations of these restrictions are available from the Credit Union.

E. Account Information

Access to my account will be by means of my Credit Union access code (PIN) containing no less than 4, and up to 8 digits. The Credit Union will initially assign you an access code. On your first usage of the PAT system you will be required to change your code to any code of 4 digits. On first usage of the Online Banking system you will be required to change your code to any code of not less than 4 digits and no greater than 8 numeric characters. I understand that if I wish a joint owner of my account to have access to the account, he/she must use the same access code (PIN) I use. I agree not to give my access code to any person not authorized to have access to my account.

F. Liability for Unauthorized Transfers

I will tell the Credit Union at once if I believe my access code (PIN) has been lost or stolen. Telephoning is the best way of keeping my losses down. I could lose all of the money and the funds in my overdraft line of credit if I fail to notify the Credit Union. If I notify the Credit Union of the loss or theft of my access code within 2 business days after I learn of it, my loss will be limited to $50. If I fail to tell the Credit Union within 2 business days and the Credit Union can prove that it could have prevented the loss, I could lose as much as $500. I have 60 days after my statement is mailed to me to tell the Credit Union of the transfers I did not make. If I fail to notify the Credit Union within 60 days, I may not get my money back. I understand the Credit Union may extend this period if I can provide a good reason for not notifying the Credit Union sooner.

If I believe my access code (PIN) has been lost or stolen or that someone has transferred or may transfer money from account without my permission, I should call 816.221.2734 during regular office hours or write the Credit Union at: 533 Campbell ST, Kansas City, MO 64106.

G. Statements

I will receive a statement each month unless there has been no activity. In any case, the Credit Union will issue a statement at least annually. All transactions generated by me through Online Banking will appear on my statements. No other receipts will be sent.

H. Credit Union’s Liability

If the Credit Union does not complete the transaction for which I received a confirmation number or it is not completed for the correct amount, it will be liable for my reasonable losses or damages. However, there are some exceptions: (1) if, through no fault of the Credit Union, I do not have sufficient funds in my account. (2) if the transfer would exceed the credit limit on my line of credit. (3) if circumstances beyond the Credit Union’s control (such as fire or flood) prevent the transfer despite reasonable precautions that it has taken. (4) if funds are subject to legal encumbrance which prohibit transfers. (5) if the Credit Union fails to receive necessary transfer data or the data received is erroneous or incomplete.

I. Errors and Questions

In case of errors or questions about my electronic transfers, I should telephone the Credit Union at 816.221.2734 or write the Credit Union at 533 Campbell ST, Kansas City, MO 64106. I must notify the Credit Union no later than 60 days after I am sent the first statement on which the error or problem occurred. I will need to tell the Credit Union;

  • My name and account number;
  • Why I believe the error occurred;
  • Approximately when the error took place

If I tell the Credit Union orally, it may require that I send my complaint or question in writing within ten (10) business days. The Credit Union will tell me the results of its investigation within ten (10) business days and correct any error promptly. If the Credit Union needs more time it may take up to 45 days to investigate, but I will have the use of the funds in question after the ten days. If the Credit Union determines that there was no error, it will send me a written explanation within three (3) business days after it completes our investigation. I may ask for copies of the documents that were used in the investigation.

J. Third Party Disclosures

The Credit Union will disclose information to third parties about your account or the transfers you make: (1) where it is necessary for completing transfers; (2) in order to verify the existence and condition of your account for third-party, such as a credit bureau or merchant; (3) in order to comply with government agency or court orders; or (4) if you give us permission.

K. Business Day

The Credit Union’s business hours are Monday and Friday 9 AM to 6 PM, Tuesday and Thursday 9 AM to 5:00 PM, Wednesday from 10 AM to 5 PM and Saturday from 9 AM to 1:00 PM except on the holidays it elects to remain closed. Some branch offices may be open at other hours, but the main office is open as outlined.

L. Additional Disclosures Related to Credit Applications

By clicking below, you promise that everything you state in your application is correct to the best of your knowledge and the information is accurate and complete. You authorize the Credit Union to obtain credit reports in connection with this application for credit and for any update, increase, renewal, extension or collection of the credit received. You understand that the Credit Union will rely on the information in this application and your credit report to make its decision. If you request, the Credit Union will tell you the name and address of any credit bureau from which it received a credit report on you. It is a crime to willfully and deliberately provide incomplete or incorrect information in this application. If you are applying for a credit card, you understand that the use of your card will constitute acknowledgement of receipt and agreement to the terms of the credit card and disclosures. You grant the credit union a security interest in all individual and join share and/or deposit accounts you have with the Credit Union now and in the future to secure the credit card or any loan. When you are in default, you authorize us to apply the balance in these accounts to any amounts due. Shares and deposits in an Individual Retirement Account, and any other account that would lose special tax treatment under state or federal law if given as security, are not subject to the security interest you have given in your shares and deposit accounts. You also agree that all terms outlined in the Membership and Account Agreement given when you open an account, will also apply to any extension of credit.

M. Other Terms & Conditions

The Credit Union may occasionally introduce new services to enhance the existing program. It will notify me of these new enhanced Services and by utilizing the Services, I agree to be bound by the obligations and conditions concerning the Services. In addition to the terms set forth in this agreement, I agree to be bound by all the terms and conditions of any separate instructions that I may be provided with in conjunction with the system and any and all applicable state and federal laws and regulations.

The Credit Union reserves the right to terminate my use of the PAT or Online Banking, in whole or part, at any time without prior notice.

This agreement is subject to change from time to time. Communications maybe posted on the Online Banking webpage or delivered to the email address I provided or to my last known mailing address. Any electronic Communication sent by email will be deemed to have been received by myself when it is sent to me. Any Communication posted on the Online Banking webpage will be deemed as received by me no later than 30 calendar days after it has been posted. I agree that these are reasonable procedures for sending and receiving electronic Communications. My use of PAT and Online Banking following the receipt of such notice constitutes acceptance of such amendment.

It is my responsibility to notify holy Rosary Credit Union anytime I should have a change my email address or mailing address, or if I wish to remove any account from PAT or Online Banking. I may change my email or mailing address I written and signed request sent to: Holy Rosary Credit Union, 533 Campbell ST., Kansas City, MO 64106 or; or by calling 816.221.2734.

The Online Agreement and Electronic Funds Transfer Disclosure shall be governed by and construed in accordance with the laws of the state of Missouri. I acknowledge electronic receipt of the Terms and Conditions Agreement ("Agreement") associated with Credit Union’s PAT and Online Banking and agree that I have read and will abide by this agreement. I also agree the Credit Union does not need to provide me with an additional paper (non-electronic) copy of this Agreement unless specifically requested. In order to access and retain this disclosure I must have an Internet browser that supports 128 – bit encryption, such as Internet explorer 8.0 or 9.0, sufficient electronic storage capacity or a printer that is capable of printing from my browser. The current supported browsers I listed within the online banking help pages. Further, I understand that a copy of this agreement can be obtained by calling 816.221.2734 during regular office hours or by writing the Credit Union at: 533 Campbell ST, Kansas City, Missouri 64106.

I have the right to withdraw this consent by calling 816.221.2734 during regular office hours or by writing the Credit Union at: 533 Campbell ST, Kansas City, MO 64106.
